1.1. General Terms
1.1.1. These Terms and Conditions (hereinafter – the Terms) govern the rights, duties, and responsibilities of the Buyer and the Seller (MB Monteverde Vero) when purchasing goods from the online store.
1.1.2. The Seller reserves the right to amend or supplement these Terms at any time.
1.2. Formation of the Purchase-Sale Agreement
1.2.1. The purchase-sale agreement is considered concluded once the Buyer places an order, reads and agrees to these Terms, and confirms the order on the website.
1.3. Seller’s Rights
1.3.1. The Seller has the right to modify or supplement the Terms at any time by notifying Buyers on the website www.monteverde.lt. Changes take effect from the moment they are published and apply only to orders placed after that date.
1.3.2. The Seller has the right to temporarily or permanently suspend the operation of the online store without prior notice for important reasons (e.g., technical maintenance, force majeure, etc.).
1.3.3. The Seller has the right to reject an order if:
- The Buyer fails to provide the necessary data for fulfilling the order;
- The data provided by the Buyer is incorrect or misleading;
- The order is suspected to be fraudulent or in violation of these Terms.
1.3.4. The Seller is not obligated to fulfill an order if it cannot deliver the goods due to force majeure. In such cases, all amounts paid by the Buyer will be refunded.
1.3.5. The Seller has the right to temporarily or permanently discontinue the offering of certain products or modify the product assortment, prices, or descriptions by notifying via the website.
1.3.6. The Seller may restrict or terminate the Buyer’s access to the website if the Buyer attempts to disrupt the site’s operations or security or violates these Terms.
1.4. Seller’s Obligations
1.4.1. The Seller undertakes to provide all conditions for the Buyer to use the e-shop www.monteverde.lt properly.
1.4.2. The Seller undertakes to respect the Buyer’s right to privacy and protect personal data in accordance with applicable laws.
1.4.3. Upon receiving an order, the Seller commits to delivering the ordered goods to the address specified by the Buyer under the conditions set out in these Terms.
1.4.4. In the event of unforeseen circumstances, the Seller undertakes to promptly inform the Buyer about possible delivery delays or other order-related issues.
1.4.5. The Seller undertakes to accept and properly review all Buyer complaints and resolve justified cases as per legal procedures.
1.4.6. The Seller complies with the laws of the Republic of Lithuania governing food safety, consumer rights, and e-commerce.
1.5. Buyer’s Rights
1.5.1. The Buyer has the right to access their personal data managed by the Seller and request correction, adjustment, or deletion under applicable laws.
1.5.2. The Buyer has the right to receive clear and understandable information about product prices, delivery conditions, payment terms, and return policies before concluding the agreement.
1.5.3. The Buyer has the right to contact the Seller at any time regarding the order status, product quality, or any related issues.
1.5.4. The Buyer has the right to file a claim regarding defective or incorrect products and expect it to be resolved according to the law.
1.5.5. The Buyer has the right to cancel the order if the goods have not yet been shipped, unless otherwise restricted by law or contract.
1.5.6. The Buyer has the right to receive an invoice or other payment confirmation as required by Lithuanian law.
1.6. Buyer’s Obligations
1.6.1. The Buyer undertakes to provide accurate and complete data during the ordering process and update them if changes occur.
1.6.2. The Buyer agrees to use the e-shop in good faith and not violate Lithuanian laws or third-party rights.
1.6.3. The Buyer must pay for the ordered goods and accept them according to the applicable rules.
1.6.4. The Buyer agrees to inspect the goods upon delivery and immediately notify the Seller of any discrepancies.
1.6.5. The Buyer is responsible for keeping their account login details secure and not disclosing them to third parties.
1.6.6. The Buyer is liable for all actions performed using their account, including placing orders and making payments.
1.7. Product Prices
1.7.1. All product prices on www.monteverde.lt are listed in euros (EUR) and include VAT as per applicable regulations.
1.7.2. Delivery costs are not included in the product price. The delivery fee is shown separately during order placement.
1.7.3. Products are sold at the prices valid at the time of order placement.
1.7.4. The Seller may change product prices at any time without notice. However, such changes do not apply to already confirmed orders.
1.8. Ordering and Payment
1.8.1. The Buyer places orders on www.monteverde.lt by selecting desired products and adding them to the cart.
1.8.2. During ordering, the Buyer must provide accurate and complete information: name, surname, delivery address, email address, and phone number.
1.8.3. Payment is made via the Montonio platform (https://montonio.com) using major Lithuanian e-banking services or credit/debit cards (Visa, Mastercard, etc.).
1.8.4. The order is considered submitted only after successful payment confirmation.
1.8.5. If payment is not confirmed within 24 hours, the order may be automatically canceled.
1.9. Delivery Terms
1.9.1. Goods are delivered within the territory of Lithuania to the address specified by the Buyer.
1.9.2. Delivery is made via Omniva parcel lockers or courier services.
1.9.3. Deliveries are made on business days. Orders are dispatched the same or the next business day. Typically, delivery takes up to 5 business days unless otherwise stated or delayed due to third-party service providers.
1.9.4. The Seller may adjust the delivery timeframe by notifying the Buyer.
1.9.5. Delivery is free for orders over €40. A €3 fee applies to orders under €40.
1.9.6. For in-person pickup in Kaunas, contact us via email at info@monteverde.lt.
1.9.7. For orders over 25 kg, the Seller will contact the Buyer to agree on delivery terms.
1.9.8. Deliveries to the Curonian Spit are only made to the Omniva parcel locker in Nida or by special arrangement.
1.9.9. For parcel locker deliveries, the Buyer receives an SMS with the pickup code on the order date.
1.9.10. For courier deliveries, the courier contacts the Buyer on the delivery day with an estimated time.
1.9.11. To collect the parcel, the Buyer must present a valid ID (passport or identity card).
1.9.12. If delivery is unsuccessful due to the Buyer’s fault (incorrect data, inaccessible address, etc.):
- 1.9.12.1. The Seller may cancel the order and refund the cost of goods, excluding the delivery fee;
- 1.9.12.2. The Seller may attempt redelivery with an additional charge.
1.9.13. Upon receipt, the Buyer must check the goods and notify the Seller immediately of any discrepancies or damage. If delivered by courier, inform the courier on-site.
1.9.14. When choosing an outdoor parcel locker, the Buyer must consider weather conditions (heat, cold). If immediate pickup is not possible, we recommend choosing an indoor locker or courier delivery. The Buyer assumes responsibility for any damage due to weather.
1.10. Returns and Refunds
1.10.1. Quality food products are not refundable or exchangeable. Only obviously defective food items can be returned or exchanged.
1.10.2. Complaints must be submitted within 3 business days of receiving the goods via email at info@monteverde.lt.
1.10.3. Refunds for returned, undelivered, or defective goods will be made to the original payment method within 14 business days. If paid in cash, the Buyer must provide a bank account number for the refund.
1.11. Customer Service
1.11.1. For any questions or issues, contact us via email at info@monteverde.lt. We respond as soon as possible during business days.
1.11.2. MB Monteverde Vero complies with all applicable Lithuanian laws regulating e-commerce, consumer rights, and food safety.
7. Final Provisions
7.1. These Terms are prepared in accordance with the laws of the Republic of Lithuania.
7.2. All disputes between the Buyer and the Seller are resolved through negotiations. If unsuccessful, disputes are settled by Lithuanian courts based on the Seller’s registered office location.
7.3. The Buyer may submit complaints to the Seller in writing using the contact details provided. The Seller undertakes to respond within 14 calendar days.
7.4. A consumer Buyer also has the right to apply to the State Consumer Rights Protection Authority.
